Rental Agreement
1. RENTAL ITEMS AND FEES
1.1 The Client agrees to rent the items listed in the order confirmation at the rates specified.
1.2 A non-refundable booking deposit of 30% of your order is required at the time of booking and will be applied toward the final rental fee.
1.3 Full payment must be received no later than two (2) weeks prior to the event date.
1.4 Failure to pay by the deadline may result in cancellation of the reservation and forfeiture of the booking deposit.
1.5 Online quotes generated through the online shopping cart are preliminary estimates only.
- All online quotes are subject to verification of delivery options and access conditions.
- An official quote will be provided only after Superior Event Rentals confirms that delivery to the specified location is valid and feasible.
- The 30% booking deposit paid during checkout serves to reserve the items, pending confirmation of delivery logistics.
2. RENTAL PERIOD
2.1 Rental Rates: Rental rates are calculated based on the event day only.
For weekend events, early delivery (Friday) and late pickup (Sunday) are included in the one-day rental rate.
Additional days of actual use will be charged at the daily rate.
2.2 Standard Rental Timeline:
- For Saturday events: Delivery Friday, Pickup Sunday
- For Sunday events: Delivery Saturday, Pickup Monday
- For weekday events: Delivery day before, Pickup day after
Any variation from these standard timelines must be agreed upon in writing at least 72 hours prior to the event date. Superior Event Rentals acknowledges that the Client may have full-time employment obligations and will make reasonable accommodations for delivery and pickup times.
2.3 Extended Use: Additional charges apply if items are needed for actual use on multiple days.
Extended rental periods must be arranged at the time of booking and confirmed no later than one week prior to the event date.
3. DELIVERY AND SETUP
3.1 Delivery Hours:
- Monday to Thursday: After 5:00 PM
- Friday to Sunday: 7:00 AM to 8:00 PM
- Client will receive a 2-hour delivery window notification at least 24 hours before scheduled delivery
3.2 Delivery Fees:
- Local delivery fees as specified in the order confirmation.
- Out-of-town delivery: $3.00 per kilometer (calculated for two trips).
- Additional fees apply for:
- Stairs or multi-level access
- Extended distance from parking/loading area to setup location
- Difficult or restricted access locations
- Superior Event Rentals has sole discretion in determining the applicable delivery access fees based on the information provided by the Client and actual conditions at the venue.
3.3 Delivery Protocol:
- A responsible party must be present at delivery and pickup.
- Maximum wait time is 30 minutes.
- Missed appointments incur a $100.00 fee plus redelivery charges.
- Setup area must be clean and accessible.
- Photographic documentation of delivered items will be provided.
4. CLIENT RESPONSIBILITIES
4.1 The Client is responsible for:
- Securing and protecting all rental items
- Any theft or damage during the rental period
- Ensuring proper use of all equipment
- Maintaining a safe environment for equipment use
4.2 For Linens:
- No staples or adhesives permitted.
- Violation may result in damage fees.
- Must be returned dry and free of debris.
4.3 For Electronic Equipment:
- Proper power requirements must be met.
- Protection from weather conditions.
- Safe and proper operation.
4.4 For Dance Floors:
- While level ground is recommended, Client assumes all responsibility for use.
- Client acknowledges all liability for injuries related to dance floor use.
5. CANCELLATION AND REFUNDS
5.1 Cancellation Policy:
- Full refund of booking deposit if canceled 6 weeks or more before the event.
- No refund of booking deposit for cancellations less than 6 weeks before the event.
- Weather-related cancellations do not qualify for refunds.
6. POST-EVENT DAMAGES AND FEES
6.1 Upon pickup and inspection of rental items, Superior Event Rentals will:
- Document any damages or issues with photos.
- Notify the Client within 48 hours of any problems.
- Provide an itemized list of any charges for damages.
6.2 For any damages or violations:
- Superior Event Rentals will provide a detailed invoice with reasonable costs for repair or replacement.
- Damage costs are based on current market value for repair or replacement, not original purchase price.
- Normal wear and tear are not considered damage.
- Client must pay damage charges within 7 days of notification.
- Superior Event Rentals reserves the right to pursue legal action for any unpaid damages or fees.
- Client agrees to pay all reasonable costs associated with recovering unpaid charges, including legal fees.
7. LIABILITY AND RESPONSIBILITY
7.1 By checking the box below, the Client:
- Accepts full responsibility for all rental items during the rental period.
- Agrees to be responsible for any injuries, damages, or losses related to the use of rental items.
- Understands that Superior Event Rentals is not responsible for any claims, damages, or expenses that arise from the use of rental items.
- Agrees to cover any legal or financial responsibilities that result from the use of rental items.
8. WEATHER AND FORCE MAJEURE
8.1 The Client is encouraged to have a backup plan for outdoor events.
8.2 This agreement remains binding regardless of weather conditions.
8.3 In the event of extraordinary circumstances beyond either party's control (including but not limited to natural disasters, acts of government, public health emergencies, or civil unrest), the affected party shall notify the other as soon as possible.
8.4 In such force majeure events:
- The Client may reschedule the event to another available date within 6 months at no additional cost.
- If rescheduling is not possible, the booking deposit remains non-refundable, but 50% of any additional payments made may be refunded at Superior Event Rentals' discretion.
- Superior Event Rentals shall not be liable for any additional costs incurred by the Client due to such events.
9. RIGHT TO REFUSE SERVICE
9.1 Superior Event Rentals reserves the right to:
- Refuse service to any Client at its sole discretion.
- Cancel or terminate this Agreement if, in its judgment:
- The rental items may be exposed to unreasonable risk of damage or loss.
- The delivery or setup location presents unsafe conditions.
- The Client has violated any terms of this Agreement.
- The Client has a history of late payments or damages.
9.2 In the event of such refusal or cancellation by Superior Event Rentals, any deposit paid may be refunded at Superior Event Rentals' discretion.
10. GOVERNING LAW AND DISPUTE RESOLUTION
10.1 This Agreement shall be governed by the laws of Ontario, Canada.
10.2 Any disputes arising from this Agreement shall first be addressed through good-faith negotiation between the parties.
10.3 If negotiation fails to resolve the dispute within 30 days, either party may pursue legal remedies.
10.4 The parties agree that the courts of Ontario shall have exclusive jurisdiction over any legal proceedings.
11. MODIFICATION OF ORDERS
11.1 Requests to modify orders must be submitted in writing no later than 7 days prior to the event date.
11.2 Additional items are subject to availability and may incur additional delivery fees.
11.3 No modifications will be accepted within 72 hours of the event at Superior Event Rentals' discretion.
12. LIABILITY LIMITATIONS
12.1 Client is strongly encouraged to obtain event insurance for their protection.
12.2 Superior Event Rentals' maximum liability related to this rental agreement is limited to the total rental fee paid for the event.
12.3 Client's maximum liability for damages to rental items is limited to the current replacement value of the specific items damaged, not to exceed 3 times the total rental fee.
12.4 By accepting this agreement, Client acknowledges that they assume all risks associated with the use of rental items.
